Terms of Engagement
Carli Thorpe is a qualified and insured trauma-informed somatic coach, hypnotherapist and energy guide, providing trauma-informed coaching, hypnotherapy and energy guidance services to support clients on their journey to living a healthier and happier life. The services are designed to empower clients to live their truth, heal from the past and feel aligned on all levels - physically, emotionally, mentally and spiritually.
Â
Carli works in service to a world where each individual has the knowledge, tools and techniques to take personal responsibility for their health and wellbeing.
Â
Carli Thorpe and you agree as follows:
Â
1. Our principal obligations to each other
Carli Thorpe agrees to develop and provide coaching, hypnotherapy and energy guidance services below in clause 2 to you employing a range of methodologies to suit your goals, personal values and style. Advice given by us is designed to support and supplement and focus your efforts, and give you guidance and encouragement. But your engagement and openness to the methods proposed is essential to the results you will achieve, and although we are confident of our processes and the quality of our inputs, we cannot guarantee particular outcomes for you.

2. Services
Â
Coaching and/or hypnotherapy and/or energy guidance sessions, the number and frequency of which are to be agreed, or booked on a session-by-session or container-by-container basis.
Â
Where sessions are booked within a container (e.g. 3-months or 6-months) all sessions included within the container should ordinarily be used within the agreed time-period unless otherwise agreed in writing. Where no agreement is given to exceed the container time-period, unused sessions cannot normally be redeemed after the agreed coaching period unless otherwise agreed in writing.

The services do not constitute traditional talking therapy, counselling or medical care and advice of any kind. You understand and agree that we are not medically trained health care professionals, cannot diagnose, treat, or manage medical conditions, and that methodologies adopted as part of the services cannot be used for medical diagnostic, care, or treatment purposes. The services do not replace or substitute psychiatric or psychological treatment, and if you are currently under any form of medical care, psychiatric care, psychological therapy or under the influence of any medication, you will inform us prior to us working together.

You are responsible for informing Carli Thorpe of any significant changes to your physical or mental health, medication, or circumstances that may affect your suitability for the Services.
Carli Thorpe reserves the right to decline or discontinue services where they are considered outside the scope of practice or where another professional service would be more appropriate.

Where sessions are taking place online, the client is responsible for ensuring a quiet, private location with a stable internet connection.

Online sessions may not be recorded by either party without prior written agreement.
Â
3. Payment
You agree to pay the agreed amount in full in advance of the commencement of the services by payment link or bank transfer as agreed to the bank account specified by Carli Thorpe at the time of booking. A payment plan may also be agreed directly with Carli, which will be in writing by e-mail communication.

A 75% refund is available only where cancellation is made in full and in writing more than 7 calendar days prior to the commencement of the services. 25% is retained to reflect administrative time and costs already incurred.Â

If you cancel within 7 calendar days prior to the commencement of the services, a 50% refund is available on the same terms as above. 50% is retained to reflect administrative time and costs already incurred, and loss of time available for other clients to schedule sessions.

No refund will be offered where cancellation occurs after the commencement or commencement date of the services.

If you book services online, you expressly request that the Services begin before the expiry of the statutory 14-day cooling-off period. You acknowledge that once the Services have begun, you lose your statutory right to cancel under the Consumer Contracts Regulations.
Â
4. Confidentiality
Carli Thorpe will treat all information received from you (except information made publicly available by you) as confidential and will only disclose it:
Â
-
with your explicit consent;
-
where required by law;
-
where there is a serious risk of harm to yourself or others; or
-
where safeguarding obligations arise.
Â
5. Intellectual property
Materials remain the intellectual property of Carli Thorpe and are provided solely for your personal use. They may not be copied, distributed, reproduced or used commercially without written permission.
Â
6. Exclusion and limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.
Â
Subject to the above, Carli Thorpe's total liability arising from the Services shall not exceed the amount paid by the Client for the relevant Services.
Â
7. Force majeure
Neither party shall be liable for any failure or delay in performing their obligations where such failure results from circumstances beyond their reasonable control.
Â
8. Data protection
Personal data will be processed in accordance with the UK GDPR and Data Protection Act 2018. Details of how personal data is collected, stored and used are set out in the Privacy Notice.
Â
9. Termination
Carli Thorpe reserves the right to suspend or terminate services where:
Â
-
Continuing would fall outside professional competence
-
The relationship is no longer therapeutically appropriate
-
Payment terms are breached
-
Abusive or inappropriate behaviour occurs
-
Trust and safety cannot reasonably be maintained.
Â
Where services are terminated by Carli Thorpe for reasons other than client breach of these Terms, any fees paid in advance for Services not yet delivered will be refunded on a pro-rata basis.
Â
10. Applicable Law
All contracts for the supply of the services by Carli Thorpe will be governed by the laws of England and Wales and exclusively justiciable in the English courts.
11. Cancellation and rescheduling of appointments
Appointments will take place on the agreed date, time and location (or online, where applicable).

Client cancellations and late arrival
-
If you need to cancel or reschedule an appointment, you agree to provide at least 24 hours' notice wherever possible.
-
Appointments cancelled with less than 24 hours' notice, or appointments not attended, will normally be treated as forfeited and are non-refundable.
-
Where appointments form part of a coaching container or block booking, the forfeited session will be deducted from your remaining sessions.
-
If you arrive late, the session will still finish at the scheduled end time. Arrivals of more than 15 minutes late may be treated as a missed appointment at Carli Thorpe's discretion.
-
Exceptional circumstances are recognised, and reasonable discretion may be exercised on a case-by-case basis.
-

Carli Thorpe cancellations and late arrival

Carli Thorpe will make every reasonable effort to attend appointments as agreed and, where possible, will provide at least 24 hours' notice if an appointment needs to be cancelled or rescheduled.

If Carli Thorpe is late, every reasonable effort will be made to either extend the session, arrange an additional session to make up the lost time, or agree an alternative appointment.

If Carli Thorpe is unable to attend an appointment, you will be offered the opportunity to reschedule. If a suitable alternative appointment cannot be agreed, a refund will be provided for the affected session. Where the appointment forms part of a coaching container, all remaining sessions will continue as planned unless otherwise agreed.

12. Emergency Situations
Coaching and hypnotherapy are not crisis services. If you are experiencing a mental health emergency or are at immediate risk of harm, please contact your GP, NHS 111, emergency services or the Samaritans as appropriate.
Â
By commencing with the Services with Carli Thorpe, you are agreeing to proceed under the Terms of Engagement set out in this document.
